A. Real Estate
Transactions
Our attorneys represent a wide variety of clients in
virtually all aspects of real estate transactions. This includes
representing clients purchasing or selling residential commercial real
estate, industrial and other transactions.
Our attorneys have expertise in the acquisition and development
of real estate and the disposition of real estate including handling tax
deferred exchanges.
We represent numerous clients in connection with the
design, development, purchase and sale of real property, for both commercial
and residential markets, including first time home buyers, experienced
business and commercial land owners and operators as well as landlords and
tenants. For example, we recently successfully caused a lis pendens to be stricken,
thereby allowing our client to complete his purchase of commercial and
residential property in Philadelphia.
We previously represented a developer of a 4000 acre residential and resort
project which included such diverse uses as a ski area, motel, restaurant and
ski lodges and related accommodations, as well as water and sewer
utilities. Our clients include the developers of two modest shopping
centers, whom we assisted in purchase of the land, financing, zoning and land
use approvals, and permits (both building and environmental).
We have represented clients in acquiring real estate for
development, including obtaining all required approvals for the conversion of
a historic school building into condominiums. Our work included
negotiating the purchase agreement, obtaining required zoning approvals,
preparation of the condominium documents and sale of the converted
condominiums units. Our clients include major developers in the Philadelphia area.
B. Land Use Planning
Our attorneys have experience handling a wide range of
land use planning matters including zoning boards, governing bodies and all
courts in which appeals of administrative decisions may be pursued, as well as coordination between and among
local and state agencies.
We represent landowners and developers in all phases of
real estate development from simple minor dimensional variance applications
to large complex projects involving significant developments and complex land
use issues. Our attorneys routinely handle the most complex of land use
matters and are experienced at assembling and managing the team of experts
required to proceed with land use applications and
appeals.
Our attorneys also have vast experience resulting from
both past and present municipal solicitorships.
The experience gained by understanding the inner workings of governmental
entities provides unique insight enabling our attorneys to fully understand
the land use process. Our attorneys have handled such projects as a
4,000 acre mixed use residential and commercial project in northeastern Pennsylvania;
a 300,000 square foot office development in Conshohocken, PA; a 486,000
square foot mixed use office, hotel and retail development in Conshohocken,
PA; the conversion of several former industrial buildings into residential
buildings; opposition to a 22 acre development in Bucks County, PA, which led
to the permanent preservation of 22 pristine acres of land; numerous land use
appeals; and numerous other land use matters. Our attorneys have
published numerous articles and spoken at seminars involving land use
law.
C. Landlord and Tenant
Our attorneys handle all aspects of landlord and tenant
law, whether it is preparation of a lease for a single apartment or review of
a complex series of leases for a major commercial or industrial site.
We represent both landlords and tenants and attempt to negotiate fair and
reasonable lease terms for all parties involved.
In addition to negotiating and drafting leases, we have
been involved in all types of disputes regarding landlords and tenants
law. We represent clients in all forums and handle appeals when our
clients believe the initial tribunal has improperly decided a matter.
Our attorneys have drafted complex shopping center and
office leases representing both landlords and tenants, including difficult issues such as common area
charges, special rent situations, non-competition agreements, subordination,
non-disturbance and adornment agreements, confession of judgment clauses and
other issues.
D. Real Estate Litigation
Our attorneys have litigated a wide variety of disputes
involving real estate. These range from enforcing terms in an agreement
of sale to appearing before a boards of view in
condemnation matters and litigating zoning appeals. Our attorneys have
the experience necessary to handle virtually any dispute involving real
estate.
