General Litigation


Our litigation attorneys have represented individuals, corporations, private non-profit corporations, partnerships and other business and non-business entities, as well as various government agencies, in a broad range of cases, in court, before administrative agencies and in various alternative dispute resolution forums.  These matters range from the seemingly simplest intra-family disputes to major business, commercial, real estate, contract, warranty and product claims and disputes, and include all manner of personal injury claims and defenses.  In addition, we have represented many clients in matters involving control and ownership of businesses and business assets, and corporate and other business entity governance as well as defending against claims by minority shareholders related to alleged oppressive majority shareholder practices.  The diversity of our experience allows us to quickly understand and formulate the management and handling of litigation matters to protect the interests of our clients, whether they are pursuing or defending against claims, and regardless of the forum.

We are sensitive to our clients’ needs and to the cost of litigation and the adverse impacts which the support of litigation sometimes causes.  Our overall aim is to zealously represent our clients, without forgetting that it is our clients’ interest which we serve, rather than our own.  Our experience includes various matters in courts in several different states and territories, including Pennsylvania, New Jersey, the District of Columbia, Puerto Rico, the Virgin Islands, California, Delaware, Ohio, Texas, Massachusetts, Michigan, Florida, Connecticut, New York, Alabama, and others and international and national arbitral forums, as well as the Maritime Arbitration Association, and direct representation as well as support to litigation counsel in several foreign states.  We have successfully represented our clients’ interests in defending against claims by terminated agents and employees, as well as in recovering damages from agents for breach of fiduciary duties.  We have also successfully recovered damages from agents and others standing in a fiduciary relationship to our clients who have misused confidential information.

We have represented governmental agencies and local governments in litigation ranging from employment disputes, environmental claims and defenses, personal injury defense, and miscellaneous contract and regulatory disputes, and as special environmental counsel to a local housing agency concerning the impact of a multi-million gallon petroleum hydrocarbon spill which underlies one of its housing complexes.  We also represented a local Borough in defense of employee claims, as special environmental counsel in dealing with storage tank matters as well as claims related to a contaminated site near a recreation, and a County redevelopment agency in defending the agency against claims related to a failed development project. 

The range of our litigation practice is graphically revealed in our maritime experience (see Maritime Transactions and Litigation) which describes some of the diverse disputes we have handled for our clients.  These have included maritime personal injury matters, losses related to oil and hazardous chemical spills, fires and explosions, strandings, collisions, allisions and other marine casualties, employee exposure to asbestos and other chemicals, marine contract, insurance and charter disputes, as well as management contract disputes, and special marine contract litigation in court and alternate dispute resolution forums.

An important element in our litigation practice is the diversity of non-legal experience of many of our litigation attorneys.  They are former mariners, engineers, scientists, registered nurses, environmental scientists, contractors and project managers, claims adjusters, government regulators, Army and Naval officers and have other relevant life experiences.  They are seasoned litigators who bring all of these experiences to bear in the active representation of our clients’ interests.
