Estate Planning and Estate Administration

The Mattioni Wills and Estates practice group encompasses the full range of estate planning, business succession planning and estate administration services for individuals, closely-held businesses and estates.

Estate planning means planning for all of life's major changes - marriage, divorce, birth of child or grandchild, starting a new job, purchasing, expanding or selling a business, planning for retirement, disability, the death of a spouse or other family members and, of course, one's own death

We work with our clients regarding:

-          Wills

-          Financial powers of attorney

-          Medical powers of attorney

-          Health care directives (living wills)

-          Establishment of irrevocable life insurance trusts, grantor retained annuity trusts, qualified personal residence trusts, and generation-skipping trusts

-          Establishment of charitable remainder and lead trusts

-          Family limited partnership agreements

-          Will contests

-          Will and Trust review and interpretation

-          Orphans’ Court and Surrogate’s Court litigation

-          Other Related Life Events Planning

Our focus at Mattioni is to ensure that the wishes of the client, and the client's family, are met in a way that will reduce the degree of uncertainty concerning asset distribution to beneficiaries, as well as to limit the effect that taxes can have on the net value of the estate.  We counsel our clients on strategies that will allow them to take advantage of the tax-reduction measures that remain available under current income and transfer tax laws.

When death occurs, the estate lawyers at Mattioni are available to assist in the administration of the decedent’s estate, from the initial probate proceedings through the completion of the administration process, culminating with the final distributions to the beneficiaries or heirs and “closure” of the estate.  Estate administration includes, but is not limited to, the following:

-          File probate petitions with the Register of Wills in Pennsylvania and Surrogate’s Court in New Jersey on behalf of the Executor or Administrator

-          Gather and value the assets of the decedent’s estate

-          Coordinate with creditors and settle the debts of the decedent’s estate

-          Distribute assets to beneficiaries through Will or Trust provisions

-          File state and federal inheritance and estate tax returns

-          File the closing paperwork with the state government

The attorneys in the Wills and Estates practice group are committed to serving the specific needs of each individual client.  Through careful advice and analysis, we provide our clients with estate plans and estate planning documents which are tailor-made to assist them in achieving their particular estate planning and personal goals.  In addition, the experience and expertise of our attorneys involved in estate administration can be a valuable asset to you during a difficult time.
